Russian invention patents are published in the patent gazette 18 months after the patent application date or priority date. Within 48 months from the filing date or priority date, the applicant or any other person may file a request for substantive examination of the patent application. The Patent Office will examine the patent application according to the serial number of the request for actual examination. The notice of first examination opinion (FER) will be issued to the applicant or his agent within 6 months from the date of filing the request for actual examination or the publication of the patent application (whichever is earlier). Applicants should complete amendments to the application documents within 12 months from the date of the FER to meet the authorization conditions, and this period cannot be extended. If all the defects of the patent application are not eliminated within the prescribed period, the patent application will be rejected. If the patent application meets all the requirements, it will be granted a patent right and published in the patent gazette. After the patent is granted, anyone can file an objection within 1 year from the date of publication of the patent grant.

3.Russian Patent Application Procedure:

1,Patents need to use language

Patent applications filed in any language can obtain a filing date, but patent applications filed in non-Russian languages require a Russian translation within two months of the filing date.

2,Situational requirements for patent applications

For PCT applications, the period of entry into the national phase is 31 months from the earliest priority date; for directly filed national applications, the period of filing is 12 months from the earliest priority date. The documents to be submitted include: the description with the drawings, the name and contact details of the applicant (s) and the inventor (s). For PCT applications entering the national phase, only the application number of the PCT application may be provided. The Russian translation of the application documents and information on the application number and date of application of the earlier application can be provided within 2 months from the date of application. For non-PCT applications, a copy of the earlier application must be provided within 16 months of the priority date.

3,Review procedures

The Russian Patent Office conducts formal and substantive examination of the application documents. The formal examination is carried out after the Russian translation of the application document has been submitted to the Patent Office. In the case of a duly accepted application, a request for substantive examination must be submitted within three years from the date of application (international filing date). The notification of the first review is expected to be received within one year of the request for actual review. The response to the notice of review must be submitted within two months. The response period may be extended month by month for a total of up to 10 months. The application is published 18 months after the date of the national application.

4,Fees payable upon authorization

The authorization registration fee and the accumulated annual fee must be paid within 6 months after the issuance of the authorization notice. After payment of the fee, the patent is authorized and published.

If the appeal procedure is not satisfied with the decision of rejection, an appeal may be filed with the Patent Disputes Board of the Patent Office within six months.
